While determining the specific purpose for which BPO services are to be engaged, an establishment should ensure that the same is permissible under law and / or whether they are regulated. Moreover, in certain cases, outsourcing, even if it be of business processes in banks, financial institutions or of insurance companies may become complicated as it might come under the purview of Contract Labour (Regulation & Abolition) Act, 1970 and require specific registration by both the establishment and the provider.
Further in cases where an establishment, not carrying on business in India, engages the services of a Provider who is resident in India and such provider is under the control and / or management of the establishment, one would require to ensure that the Provider complies with the requirements of the new transfer pricing regulations under the Income Tax Act.
